Definitions The member listed above and/or who sign below will be referred to as the “Member”. The Richmond Oval 0827805BC LTD will here and there after be referred to as The Richmond Olympic Oval (ROO) at the address set out below. ROO, its representatives and assignees will be referred to as the “Operator”. The release form shall mean the Assumption of Risks, Informed Consent, Release of Liability, Waiver of Claims and Indemnity Agreement”. “Agreement” shall mean the contents of the Membership Agreement and the Release form. Member use of ROO services and facilities will be governed by the Agreement. Membership Type This non-transferrable membership is limited to the user names(s) indicated above. Unless indicated otherwise, the membership includes: access to ROO listed herein during regular hours of operation, new member orientations by ROO staff, cardiovascular machines, weight training machines, free weights, fitness classes (as indicated on schedule).
Membership Fee In consideration of the Operator granting the member immediate membership to ROO the prospective member shall pay the ROO a fee. Failure on prospective member’s part to take advantage of the privileges of membership shall not relieve the member from payments due. Automatic Fees Members hereby authorize ROO to adjust payments for any changes to the following: a. Goods and Services Tax (GST) and Provincial Sales Tax (PST) when applicable. Pre-Authorized Payment Options The member hereby authorizes the ROO to deduct monthly membership fees from my Credit Card (Visa, Mastercard or American Express). If funds are unavailable, the ROO will attempt to withdraw fees a second time. The ROO will charge back to the member any cost charged by the bank/financial institution. Amounts not paid in full within 10 day of the member’s due date will be subject to a payment charge of 5% of the unpaid amount. There is a $50 collection charge for any payment which is returned as insufficient funds, or not honoured, with the exception of these returned amounted satisfied by further bank debits.
Membership Cancellations & Holds ROO memberships may be put on hold once per anniversary year for a maximum of one (1) month. A $25 administrative fee will be charged at the time of the hold.
In the event a member wants to cancel their membership, fifty percent (50%) of the remaining membership fees will be charged, unless the member presents a certified medical reason or proof there has been a change of residence of more than 80 km away from the ROO. Membership cancellations must be done by a method that will allow proof of notice, including registered mail, electronic mail, facsimile, or in person. Cancellations and Holds will not be accepted by phone.
Cancellation Within 10 Days:
This is a contract to which the Business practices and Consumer Protection Act applies, Section 21 (1). A member may cancel this contract from the day the member enters the contract until 10 days after they receive a copy of this contract. A reason for cancelling is not required. To cancel the member must give notice of the cancellation at the following address: 6111 River Road Richmond, BC.
Membership Rates Membership rates are subject to change. Should there be any fee increase in membership, it will take effect at the time of renewal. Members will receive notification of a fee increase in advance. It is the member’s responsibility to inform the ROO of any changes in their mailing address, credit card information or email address.
Administration Fees There will be a $10 replacement card fee for lost of stolen cards. Only members in good standing with proof of identification may be eligible to have a replacement card issued. Breach of the Terms of this Agreement
If the Member fails to make any payment required by this Agreement, or if the Member breaches any material term of this Agreement, the ROO may, at its sole option declare this Agreement terminated and the Member shall not be entitled to claim any damages, reimbursement, compensation or remuneration of any kind in respect of such termination.
Privacy ROO collects and uses a member’s personal information primarily for the purpose of providing the member with programs and services requested from us. ROO may also contact the member from time to time about their membership account or to conduct market research and surveys in an effort to continually improve ROO’s products and service offerings. ROO may share a member’s information with select third parties who are acting on the member’s behalf as their agents, suppliers, or service providers. ROO or this third party may conduct personal credit investigations, or report the member’s account information to a reporting bureau for the purposes of collecting overdue amounts and updating appropriate credit information.
Representation The member represents and warrants to ROO that all information supplied by them on the contract is true and that the member is physically able to use the services and/or the facilities at ROO.
The Operator reserves the right to cancel, reschedule or alter facility usage in the event that conditions arise that necessitate cancellations or alterations, including, without limitation: strikes, lockouts, fire, flood, interruption of utility service, earthquake or other “acts of God”, war, terrorist acts or other events beyond the reasonable control of the Operator. In the event of such cancellation, rescheduling or alteration, the member shall have no claim against the Operator for damages.
In the event of a major emergency (e.g. earthquake, fire, flood) in the area, the ROO may be taken over, without notice, by the City of Richmond for the implementation of an emergency plan and the Member Group shall have no claim against the ROO for damages.
Entire Agreement The member acknowledges that this agreement, and any other forms completed at the same time, constitute the entire understanding between the member and ROO, and that no other understanding or agreement exists between the member and ROO, and that neither ROO nor any of ROO’s representatives or employees have made any express or implied warranties or representation of any kind to induce the member to enter into this agreement, (including without limitation that ROO’s programs, facilities, or advice have been or are approved by any medical authority) other than those warranties or representation set forth in this Agreement.
Neither the member nor ROO may change this agreement unless such changes are agreed to in writing and signed by both the member and ROO; with the exception of calculation errors and automatic fees listed on the front of this agreement.
If any portion of this agreement is held to be invalid, the remainder of the agreement shall remain in full force and effect.
Hours of Operation The hours of operation may change subject to public response and requirements of the ROO. During regular hours of operation there is potential that maximum capacity could be reached, should this occur ROO retains the right to limit service.
The member shall not bring or consume alcoholic beverages in or in the Facility except in a licensed restaurant or premises. Smoking is prohibited on ROO property.
The Member Group shall not broadcast music in the ROO without the prior approval of the Operator. The Member agrees that music sound volumes shall be kept to a reasonable level (in the opinion of the Operator).

The Member shall be held financially responsible for any damage to the Facility or loss of or damage to of any equipment resulting from the Member’s use of the ROO. 3. The Member’s use of the ROO shall not cause unreasonable interference with the orderly functioning of the ROO or infringe upon the rights or privileges of other users of the ROO. 4. The Member’s use of the ROO shall not promote hatred or discrimination against, or expose to contempt, any person or group of persons contrary to applicable law. 5. The Member shall act in a considerate, legal and sportsmanlike manner when using or occupying the ROO. Abusive language or illegal or inconsiderate behaviour may result in the cancellation of the Member’s rights to use the ROO. The Member shall comply with all rules and regulations established from time to time by the Operator. 6. The Operator shall have the right at any time to eject from the ROO or to refuse admittance thereto of any person or persons who, in the opinion of the Operator is or are creating a disturbance or behaving in an illegal, objectionable or improper manner. The member agrees that while participating in ROO services and facilities the member’s conduct will at all times be such that it presents no danger to other members or staff, and does not interfere with the enjoyment of other members or staff, or disrupt the staff in performing their duties. 7. ROO reserves the right to take whatever action deemed necessary to ensure that the member or any guests of the member complies with ROO’s rules, regulations and privileges. ROO, may in its absolute discretion, suspend or cancel the rights and privileges of membership of any member for any reason at any time. Assignment The Member may not assign the Member’s rights hereunder. In consideration for the ROO permitting the use of the Facility by the Member, the Member agrees to the following terms and conditions: Indemnification: The Member shall indemnify, defend and save harmless the Operator, ROO, the City of Richmond and their respective officers, employees, agents, contractors, successors and assigns from and against any and all losses, claims, actions, damages, liability, costs or expenses, including legal fees on an indemnity basis, claims for personal injury or death, property damage, or any other loss or damage (the “Losses”) arising out of or caused by any breach of the terms of this Member Agreement any the Member’s use of the ROO. PAR-Q (Participation Activity Readiness Questionnaire): All members are required to complete a PAR-Q form upon registration and on the anniversary date of each membership year. Release and Waiver of Risk: The Member shall use the ROO at the Member’s own risk and agrees that the Operator has made no warranties or representations respecting the condition or suitability of the ROO for the Member’s proposed use. The Member hereby releases the Operator, ROO, the City of Richmond and their respective officers, employees, agents, contractors, successors and assigns from any and all losses incurred or suffered by the Member which arise directly or indirectly out of the Licensee’s use and occupation of the ROO. A) Agrees to be responsible for any and all damage caused by the member or his/her guest(s) to the premises or equipment of the servicing club B) Acknowledges ROO is not responsible for the loss of theft or damage to personal property C) Acknowledges that any member may be expelled from ROO. Cause for expulsion may consist of violation of any rule or regulation of ROO or of any conduct that in the opinion of ROO is prejudicial to the welfare, good order and character of Richmond Olympic Oval.

The Member shall indemnify, defend and save harmless the Operator, ROO, the City of Richmond and their respective officers, employees, agents, contractors, successors and assigns from and against any and all losses, claims, actions, damages, liability, costs or expenses, including legal fees on an indemnity basis, claims for personal injury or death, property damage, or any other loss or damage (the “Losses”) arising out of or caused by any breach of the terms of this Member Agreement any the Member’s use of the ROO.
